1. Introduction and Acceptance

Welcome to EarnHive, operated by EarnHive LLC ('we', 'us', or 'our'). These Terms of Service ('Terms') govern your access to and use of the EarnHive platform, website, mobile applications, and all related services (collectively, the 'Platform').

By creating an account, accessing, or using any part of the Platform, you agree to be bound by these Terms and all policies referenced herein, including our Privacy Policy, Cookie Policy, and Affiliate Policy. If you do not agree to these Terms, you must not access or use the Platform.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

2. Legal Agreement

These Terms constitute a legally binding agreement between you and EarnHive LLC, a limited liability company registered at 612 Main St Suite 220 #1022, Stroudsburg, PA 18360, United States.

By using the Platform, you represent that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. You also represent that you have the legal authority to enter into this agreement.

3. Eligibility Requirements

To use EarnHive, you must meet all of the following eligibility requirements:

• You must be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater
• You must have the legal capacity to enter into binding contracts under applicable law
• You must not be located in a jurisdiction where use of the Platform is prohibited by law
• You must not have previously had your EarnHive account terminated for violation of these Terms
• You must not be using virtual private networks (VPNs), proxies, or other methods to obscure your true location or identity
• You must provide accurate, current, and complete information during registration and keep your account information updated

4. Account Registration and Security

To access most features of the Platform, you must create an account. During registration, you must provide accurate and complete information, including a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to immediately notify us of any unauthorized use of your account or any other breach of security. You may not transfer, sell, or otherwise assign your account to any other person or entity.

We reserve the right to refuse registration, suspend, or terminate accounts at our sole discretion, particularly if we suspect fraudulent activity, multiple account creation, or violation of these Terms.

5. Platform Description and Services

EarnHive is a cryptocurrency rewards platform that allows users to earn digital currency by completing various activities, including:

6. User Obligations and Conduct

As a user of the Platform, you agree to:

You are solely responsible for all content you submit, post, or transmit through the Platform. You represent that you have all necessary rights to such content and that its use does not violate any third-party rights.

• Provide truthful, accurate, and complete information when completing surveys and offers
• Complete all activities personally and not use automated scripts, bots, or other artificial means
• Use your own devices and internet connections (not shared public proxies or VPNs)
• Comply with all applicable laws and regulations in your jurisdiction
• Respect the intellectual property rights of EarnHive and third parties
• Not interfere with or disrupt the Platform or servers/networks connected to the Platform
• Not attempt to gain unauthorized access to any part of the Platform, other accounts, or computer systems

7. Prohibited Activities

The following activities are strictly prohibited and may result in immediate account termination, forfeiture of earnings, and legal action:

• Creating multiple accounts or using accounts belonging to other individuals
• Using VPNs, proxies, emulators, virtual machines, or other methods to obscure your identity or location
• Providing false or misleading information in surveys or offer completions
• Using automated scripts, bots, macros, or any other automated means to complete activities
• Attempting to manipulate, exploit, or abuse the earning system or referral program
• Coordinating with other users to artificially inflate earnings or referral counts
• Engaging in chargebacks, payment reversals, or fraudulent payment activity
• Accessing or attempting to access areas of the Platform not intended for users
• Reverse engineering, decompiling, or attempting to extract source code from the Platform
• Harassing, threatening, or abusing EarnHive staff or other users
• Promoting competing platforms or using the Platform to recruit users for other services
• Violating any applicable laws, including but not limited to fraud, money laundering, or terrorist financing laws

8. Earning System and Rewards

Users earn cryptocurrency rewards by completing activities through our third-party partners. Reward amounts, crediting timeframes, and conversion rates are displayed on the Platform but are subject to change without notice.

Credits may take up to 48 hours (or longer, as specified by the partner) to appear in your account after completion. Rewards are only credited for legitimate completions that meet the partner's requirements. EarnHive reserves the right to investigate any completion and may withhold or reverse credits if fraud is suspected.

Referral earnings are calculated based on a percentage of your referred user's validated earnings from surveys, offers, and other qualifying activities. Self-referrals and coordinated referral schemes are prohibited and will result in forfeiture of all referral earnings and account termination.

9. Cryptocurrency Payments and Withdrawals

EarnHive processes payments exclusively in cryptocurrency (USDT, USDC, and other supported digital assets). Withdrawal requests are subject to minimum balance requirements, verification procedures, and processing times as displayed on the Platform.

All withdrawal requests are reviewed for compliance with these Terms and applicable anti-fraud measures. We reserve the right to request additional identity verification, delay processing, or reject withdrawal requests if we suspect fraudulent activity, terms violations, or regulatory compliance issues.

Cryptocurrency transactions are irreversible. You are solely responsible for providing accurate wallet addresses. EarnHive is not liable for funds sent to incorrect addresses or lost due to user error.

Cryptocurrency prices are volatile and may fluctuate significantly between the time of earning and withdrawal. Displayed conversion rates are estimates and may differ from the final withdrawal amount. EarnHive does not guarantee any specific exchange rate or value.

10. Intellectual Property Rights

All content, features, functionality, and materials on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the overall design, are owned by EarnHive LLC or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose in accordance with these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works from any Platform content without our express written permission.

The EarnHive name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of EarnHive LLC. You may not use these marks without our prior written permission.

11. Third-Party Services and Links

The Platform contains links to and integrations with third-party websites, services, and content providers (including survey providers, offer walls, payment processors, and analytics services). These third-party services are not under our control, and we are not responsible for their content, privacy practices, terms of service, or availability.

Your interactions with third-party services, including survey completions, offer participation, and data sharing, are governed by the third party's own terms and policies. We encourage you to review the terms and privacy policies of any third-party services you interact with.

We do not endorse or assume any responsibility for any third-party services, and we will not be liable for any loss or damage arising from your use of or reliance on such services.

12. Disclaimers and No Warranties

THE PLATFORM IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EARNHIVE LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, secure, or error-free; that defects will be corrected; that the Platform or servers are free of viruses or other harmful components; or that the Platform will meet your requirements or expectations.

We make no guarantees about the availability of earning opportunities, the amount you may earn, the time required to reach minimum withdrawal thresholds, or the timing or success of withdrawal requests.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EARNHIVE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF EARNINGS, OR LOSS OF CRYPTOCURRENCY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE EARNED AND SUCCESSFULLY WITHDRAWN THROUGH THE PLATFORM IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED DOLLARS ($100 USD).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless EarnHive LLC, its officers, directors, employees, agents, affiliates, and partners from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

• Your use of or access to the Platform
• Your violation of these Terms or any applicable law or regulation
• Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
• Any content you submit, post, or transmit through the Platform
• Your fraudulent, negligent, or wrongful conduct

15. Account Termination and Suspension

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without cause, with or without notice, at our sole discretion. Grounds for termination include but are not limited to violation of these Terms, fraudulent activity, extended inactivity, or conduct that we deem harmful to the Platform, other users, or third parties.

Upon termination, your right to use the Platform will immediately cease. You may request withdrawal of any earned, validated balance prior to termination, subject to our verification and fraud review processes. We reserve the right to forfeit any pending or unvalidated earnings in the event of account termination for Terms violations.

You may terminate your account at any time by contacting support@earnhive.app and requesting account deletion in accordance with our Account Deletion Policy. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

16. Governing Law and Jurisdiction

These Terms and any disputes arising out of or related to these Terms or the Platform shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law principles.

You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Monroe County, Pennsylvania, for the resolution of any disputes arising out of or related to these Terms or your use of the Platform.

17. Dispute Resolution

Most disputes can be resolved informally. Before initiating any formal proceedings, you agree to first contact us at support@earnhive.app to seek an informal resolution. Provide a brief description of the dispute and your proposed resolution.

If we cannot reach an informal resolution within sixty (60) days, either party may initiate formal dispute resolution proceedings. Any claims must be brought within one (1) year of the events giving rise to the claim, or such claim is waived.

To the extent permitted by applicable law, you agree to bring any claims individually and not as part of any class or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

18. Modifications to Terms and Platform

We reserve the right to modify, suspend, or discontinue the Platform or any part thereof, temporarily or permanently, with or without notice, at our sole discretion. We may also modify these Terms at any time by posting the updated Terms on the Platform.

Material changes will be indicated by updating the 'Last Updated' date at the top of these Terms. Your continued use of the Platform after such changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Platform.

We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Platform or these Terms.
